Oscar award winning actress, Hilary Swank is filing legal proceedings against a California based company for using her images without her permission. According to the Los Angeles court, the lawsuit filed on May 10 is against Robert’s Home Audio and Video. Also attached in the lawsuit is the proprietor of the company, Randall Cordero and Cordero studios.
Swank demonstrates a savvy grasp of the law by saying that the ad campaign violates her right of publicity and denies her any revenue to be accrued. The lawsuit comprises 14 pages of legal argument, including an entire list of her career credits and honors. Although the suit does not specifically state how her image was abused, it says in part “Defendants did not ask for or receive Ms. Swank’s permission to use her photograph.” She is suing for unspecified damages. Hollywood stars are sensitive to their commercial rights and the home studio might be in deep trouble if found guilty.
